Terms of Trade

These Terms of Trade apply to all goods and services supplied by Creative Sign Solutions NZ Limited (“the Company”, “we”, “our”, or “us”).

By accepting a quotation, placing an order, or instructing us to proceed with work, the customer agrees to be bound by these Terms of Trade.

1. Quotes

1.1 All quotations are valid for 30 days from the date issued unless otherwise stated.

1.2 Quotes are based on the information provided by the customer at the time of quoting.

1.3 Any variations, additions, or changes requested after acceptance may result in additional charges.

2. Acceptance of Quote

Acceptance of a quotation may be provided in writing, by email, by electronic approval, or by instructing us to proceed with the work.

Upon acceptance, these Terms of Trade apply.

3. Deposits

3.1 For all jobs valued over $300, a deposit of 50% of the quoted price is required before work commences unless otherwise agreed in writing.

3.2 Production, ordering of materials, or scheduling may not begin until the required deposit has been received.

4. Payment Terms

4.1 The remaining balance is due within seven (7) days of completion of the work unless otherwise agreed in writing.

4.2 Creative Sign Solutions NZ Limited reserves the right to charge interest on overdue accounts and recover reasonable debt collection costs where necessary.

5. Artwork and Design Approval

5.1 Customers are responsible for carefully reviewing and approving all artwork, proofs, layouts, and designs before production.

5.2 Once approval has been given, Creative Sign Solutions NZ Limited is not responsible for errors including spelling, grammar, measurements, colours, or omissions that were present in the approved artwork.

6. Vehicle Wraps and Installations

6.1 Customers must ensure vehicles are presented in a clean and suitable condition for installation.

6.2 While every care is taken during installation and removal, Creative Sign Solutions NZ Limited is not responsible for damage resulting from:

Existing paint defects
Poor repaint work
Rust

Previous body repairs
Weak or deteriorated surfaces

6.3 Vehicle wrap lifespan may vary depending on environmental conditions, vehicle use, maintenance, and exposure to sunlight.

7. Ownership of Goods

All goods, signage, designs, artwork, and materials remain the property of Creative Sign Solutions NZ Limited until payment has been received in full.

8. Warranty

We warrant our workmanship for a reasonable period following installation.

This warranty does not cover:

Accidental damage
Misuse
Improper cleaning or maintenance
Normal wear and tear
Damage caused by third parties

Manufacturer warranties for materials may apply separately.

9. Cancellation

If a customer cancels a project after acceptance, Creative Sign Solutions NZ Limited reserves the right to charge for:

Work already completed
Design time
Materials purchased
Any costs incurred up to the date of cancellation.

10. Limitation of Liability

To the maximum extent permitted by law, our liability is limited to the value of the goods or services supplied.

We are not liable for indirect, consequential, or business losses arising from the use of our products or services.

11. Privacy

Personal information collected during the course of business will be handled in accordance with our Privacy Policy.

12. Governing Law

These Terms of Trade are governed by the laws of New Zealand.

13. Colour Matching

13.1 Every reasonable effort will be made to achieve colour accuracy.

13.2 Customers acknowledge that colours displayed on computer monitors, mobile devices, printed proofs, and samples may vary from the final produced product.

13.3 Exact colour matching cannot be guaranteed unless specifically agreed in writing prior to production.

13.4 Minor variations in colour between print runs, materials, substrates, and production methods are considered acceptable and do not constitute a defect.

14. Photography and Portfolio Use

14.1 Unless otherwise requested in writing by the customer before completion of the project, Creative Sign Solutions NZ Limited reserves the right to photograph completed work for promotional purposes.

14.2 Photographs may be used in:

Our website portfolio
Social media platforms
Marketing materials
Advertising campaigns
Printed promotional materials

14.3 We will not disclose confidential business information as part of any promotional use without the customer’s consent.

15. Customer-Supplied Artwork and Intellectual Property

15.1 The customer warrants that they own or have obtained all necessary rights, licences, and permissions to use any artwork, logos, trademarks, images, text, or other materials supplied to Creative Sign Solutions NZ Limited.

15.2 The customer agrees to indemnify and hold harmless Creative Sign Solutions NZ Limited against any claims, losses, damages, costs, or legal expenses arising from the use of materials supplied by the customer.

15.3 Creative Sign Solutions NZ Limited accepts no responsibility for copyright, trademark, or intellectual property infringements relating to customer-supplied materials.

16. Removal of Existing Graphics and Signage

16.1 Removal of existing vehicle graphics, wraps, decals, signage, adhesives, or other materials may reveal underlying issues that were not visible prior to commencement of work.

16.2 Creative Sign Solutions NZ Limited is not responsible for:

Paint damage
Clear coat failure
Surface deterioration
Colour fading
Ghosting or shadowing
Rust
Previous repair work
Adhesive residue
Damage resulting from poor-quality paint or previous installations

16.3 Where additional labour, cleaning, preparation, repair work, or remedial work is required due to conditions discovered during removal, additional charges may apply.

16.4 Any additional work required beyond the original quotation will be discussed with the customer and charged at the applicable rate.

17. Installation Delays and Site Access

17.1 Installation dates are estimates only and may be affected by factors outside our reasonable control.

17.2 Creative Sign Solutions NZ Limited shall not be liable for delays caused by:

Weather conditions
Material supply delays
Equipment failure
Site access restrictions
Customer-requested changes
Events beyond our reasonable control

17.3 Where installation cannot proceed due to customer-related delays or restricted access, additional charges may apply for rescheduling, travel, or labour costs.

18. Storage and Collection

18.1 Customers must collect completed goods, signage, or vehicles within a reasonable time after notification of completion.

18.2 Where goods, signage, or vehicles remain uncollected for more than fourteen (14) days after notification, Creative Sign Solutions NZ Limited reserves the right to charge reasonable storage fees.

18.3 Storage fees shall continue to accrue until collection or alternative arrangements have been agreed.

19. Late Payments

19.1 Accounts not paid by the due date may incur interest at a rate of 2% per month on the outstanding balance.

19.2 The customer shall be responsible for all reasonable costs incurred by Creative Sign Solutions NZ Limited in recovering overdue amounts, including debt collection agency fees, legal fees, and court costs.

19.3 Any payments received may be applied first toward collection costs, interest, and then the outstanding principal balance.

20. Variations and Additional Work

20.1 Any variation to the agreed scope of work requested by the customer after acceptance of a quotation may result in additional charges.

20.2 Additional work required due to inaccurate information, unforeseen site conditions, hidden defects, surface preparation requirements, or changes requested by the customer will be charged separately.

20.3 Creative Sign Solutions NZ Limited will make reasonable efforts to advise the customer of any additional costs before proceeding where practicable.

21. Paint Condition and Surface Suitability

21.1 Vehicle wraps, graphics, and vinyl products are designed to adhere to sound, properly cured, and well-maintained painted surfaces.

21.2 Creative Sign Solutions NZ Limited cannot guarantee adhesion, durability, or paint integrity on surfaces that have:

Been repainted or repaired
Existing paint damage
Rust or corrosion
Oxidation
Clear coat failure
Stone chips, scratches, or surface defects
Poor-quality or non-factory paint finishes

21.3 The customer acknowledges that the removal of vehicle wraps, decals, graphics, or adhesive products may expose pre-existing paint or surface defects that were not visible before installation.

21.4 Creative Sign Solutions NZ Limited accepts no liability for paint lifting, clear coat failure, surface damage, or other issues arising from pre-existing vehicle or surface conditions during installation or removal.

21.5 Where surface preparation, paint repair, rust treatment, or additional remedial work is required before installation can proceed, additional charges may apply.

21.6 Creative Sign Solutions NZ Limited reserves the right to decline installation work where the condition of the surface is likely to compromise the quality, performance, or longevity of the finished product.
